Terms & Conditions of Purchase
HioPOS New Zealand – Hardware & Software (Business Customers Only)
1. Overview
These Terms and Conditions apply to all purchases made through the HioPOS webstore (“we”,
“us”, “our”). Our products and services are supplied for business use only. By placing an order,
you confirm that you are acquiring goods and services for the purposes of a business and not as
a consumer
2. Hardware Purchases
Ownership of hardware transfers to you once full payment has been received and the goods
have been dispatched. Delivery timeframes are estimates only and may vary due to courier
delays or circumstances outside our control. Installation and setup are not included unless
explicitly stated. All hardware is sold for business use only. We do not offer change-of-mind
returns. If hardware arrives damaged or faulty, you must notify us within 48 hours of delivery.
Where appropriate, we will arrange repair or replacement in accordance with manufacturer
warranties and the Contract and Commercial Law Act 2017.
3. Software Subscriptions
Hardware purchases are one-off transactions. Software subscriptions are ongoing and billed
separately. Cancelling a software subscription does not entitle you to return hardware already
supplied

5. Warranties
Hardware may be covered by manufacturer warranties. Any warranty claims are subject to
manufacturer terms. We will provide reasonable assistance with warranty claims but are not
responsible for manufacturer decisions
6. Business Use Only & Contracting Out of Consumer Guarantees Act
All goods and services are supplied for use in trade. To the maximum extent permitted by law,
and pursuant to section 43 of the Consumer Guarantees Act 1993, the Consumer Guarantees Act
does not apply where goods or services are acquired for business purposes. By purchasing
through our webstore, you acknowledge and agree that you are contracting out of the Consumer
Guarantees Act
7. Your Responsibilities
You agree to use the hardware and software in accordance with instructions, maintain suitable
internet connectivity and power supply, ensure appropriate data security and user access
controls, and comply with all applicable laws
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, including loss of profits, business interruption, or data loss.
9. Privacy
Any personal information collected is handled in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms and Conditions from time to time. The version in force at the time of purchase applies to your order.
11. Governing Law
These Terms are governed by the laws of New Zealand, and the parties submit to the exclusive
jurisdiction of the New Zealand courts.
